Georgia Suspends Penalties for Off-Road Dyed Diesel

Friday, October 23, 2026

Governor Brian P. Kemp announced today that, working with Lt. Governor Burt Jones, Speaker of the House Jon Burns, and Commissioner of Agriculture Tyler Harper, he amended the State of Emergency Order issued last week to waive penalties for using off-road dyed diesel. This adds to the suspension of the state motor fuel tax and the removal of state weight limits on commercial vehicles included in the Executive Order dated 09.28.26.01. During the State of Emergency, no state penalties apply to selling, delivering, or using dyed fuel oil for on-road vehicle use. Governor Kemp also extended the original State of Emergency and its suspension, which now runs through November 5. Kemp said farmers and truckers are under heavy pressure and that the state is leaving no stone unturned to provide relief. Following the motor fuel tax suspension exactly a week ago, the average price of a gallon of regular gas in Georgia dropped by roughly 33 cents, according to AAA. Diesel prices fell by over 42 cents in the same period. Georgia's average regular gas price is now 51 cents below the national average.
